What steps are involved in the legal process of evicting a tenant from an apartment?

The law varies from state to state on how much notice you must receive, but you cannot actually be evicted without a court order. . . You really need to find out the law in your state.

Usually, the sheriffs department will serve you eviction paperwork and a court date. You can explain your case to the judge and see what happens.. . Usually the landlord wins, especially if you dont have things in writting that are legitiment and or your late in rent.. . In the state of Tennessee, papers will be served and then we go to court. The Judge will tell you to get out and you have 10 days. If you fail to get out, then I get the sheriffs department after obtaining a "writ of possesion" and throw your stuff out on the lawn, its actually fun then cause your so pissed off and you can smile while doing it.. Or hire me and I'll do it for you.

Yes it takes a legal paper work. I don't know how long they have to mandatoraly give you, but I do know the process... done correctly could take a long time.

Yes there has to be legal documents processed and issued.. 60 days notice if Im not mistaken.. . Search for landlord tenant act in your area and you should be able to find all the details

I think the process varies state to state, but usually the manager must give thirty days written notice. This notice can be hand-delivered, or attached to your door. The terms can be different based on your lease agreement. Read your fine print. If nothing is specified, then try to find renter's rights information for your state to see what the regulations are in your area.
